1. What Nosh Is — An Intermediary Only

Nosh is a technology platform that connects food businesses (“Sellers”) who have surplus or available food with customers (“Buyers”) who wish to purchase it, usually as surprise bags, for self-pickup (and, where offered, buyer-paid delivery).

Nosh does not make, prepare, store, handle, package, own, sell, or deliver any food. The contract of sale for any food item is directly between the Seller and the Buyer. Nosh is not a party to that sale. We act only as an intermediary / marketplace providing technology and payment-facilitation services.

2. Definitions

Seller — a food business (restaurant, café, bakery, sweet/farsan shop, cloud kitchen, etc.) listing food on the Platform.
Buyer — a customer purchasing food via the Platform.
Surprise Bag / Item — surplus or available food listed by a Seller.
Order — a reservation and payment made by a Buyer for an Item.

3. Eligibility

You must be 18 years or older and legally able to enter a contract. Sellers must be lawfully operating food businesses holding all licences required by law, including a valid FSSAI registration/licence.

4. Seller Obligations

By listing on Nosh, the Seller represents, warrants and agrees that it:

• Holds a valid FSSAI registration/licence and all other required permits, and will provide these to Nosh on request. Selling food without them is prohibited.
• Is solely and fully responsible for the safety, hygiene, quality, freshness, temperature, handling, packaging, accurate description, and lawful sale of every Item it lists, including surplus / near-expiry food.
• Will accurately describe each Item and disclose material information, including likely contents and, where relevant, allergens.
• Will comply with all applicable food-safety and consumer-protection laws (including the FSS Act, 2006 and its regulations).
• Will not list unsafe, spoiled, adulterated, mislabelled, unlawful, or unsafe-to-consume food.
• Indemnifies and holds Nosh harmless against any claim, loss, illness, injury, penalty, or liability arising from food it sold via the Platform.

Food-safety responsibility for the food sold rests entirely with the Seller.

5. Buyer Obligations & Assumption of Risk

By purchasing on Nosh, the Buyer acknowledges and agrees that:

• Items are often surplus or surprise bags; contents may vary and are not guaranteed.
• The Buyer is responsible for inspecting and checking the food (condition, freshness, smell, packaging) before consuming it, and for using their own judgement about whether it is safe to eat.
• The Buyer is solely responsible for their own allergies and dietary needs and must check with the Seller if in doubt.
• Food is purchased and consumed at the Buyer’s own risk.
• The Buyer will collect the Order within the stated pickup window and will not resell Items.

6. Food-Safety Disclaimer

Nosh does not prepare, inspect, test, certify, or guarantee any food. All food is provided by Sellers and is offered “as is”. To the maximum extent permitted by law, Nosh is not responsible or liable for the quality, safety, freshness, hygiene, fitness for consumption, or any illness, allergic reaction, injury, or harm arising from food purchased through the Platform. Any such responsibility lies with the Seller who made and sold the food. Nosh provides only the technology and facilitation service connecting Buyers and Sellers.

7. Orders, Pricing, Payments & Fees

• Prices are set by Sellers. Payment is collected in-app via our payment processor (e.g. Razorpay); Nosh does not store full card details.
• Nosh charges a service commission to Sellers and may charge a small buyer fee, disclosed at checkout. Applicable taxes apply.
• Reservation confirms the Order; the Buyer pays at the time of reservation.

8. Cancellations & Refunds

Refunds are handled per our Refund Policy. Where a Seller fails to provide a paid Order, the Buyer may be eligible for a refund. Because Items are surplus, some Orders are non-cancellable after a cutoff, which will be shown at checkout.

9. Limitation of Liability

To the maximum extent permitted by law, Nosh’s total aggregate liability to any user for any claim arising out of or relating to the Platform is limited to the amount of fees Nosh actually earned on the specific Order giving rise to the claim. Nosh is not liable for indirect, incidental, special, or consequential damages.

10. Indemnification

You agree to indemnify and hold harmless Nosh and its operator from any claim, loss, liability, or expense arising from your use of the Platform, your breach of these Terms, or (for Sellers) the food you sold.

11. Prohibited Conduct

No unlawful use, no listing of unsafe or illegal food, no fraud, no misuse of the Platform, and no infringement of others’ rights.

12. Intellectual Property

The Nosh name, logo, and Platform are owned by us. No use without permission.

13. Suspension & Termination

We may suspend or terminate accounts that breach these Terms or applicable law, including Sellers who lack valid FSSAI/licences.

14. Governing Law & Disputes

These Terms are governed by the laws of India. Courts at Bharuch, Gujarat have jurisdiction, subject to any arbitration clause we may add.

15. Changes

We may update these Terms; continued use of the Platform means you accept the updated Terms.
